When Bidding Live & Online:
This Auction is held by RT Claypoole Auction Services, LLC (the “Auction Company”) and shall be conducted in accordance with these Online Auction Terms and Conditions (“Terms”). Any person(s) who wish to bid or participate in the auction (the “Bidder”) must comply with these Terms.
Bidder affirms that they are at least 18 years old, legally competent, and not prohibited by law from owning the items they bid on.
Bidder is responsible for knowing the value and condition of items they bid on. All items are sold AS IS, WHERE IS with no warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose.
Items are available for inspection by contacting the Auction Company at 970-756-9353 to arrange a time for any Bidder to inspect the item in question. If Bidder wishes to speak to the consignor directly, please contact Auction Company and we will provide contact information. If Bidder cannot inspect the item, or Bidder is out of state, we recommend Bidder hire an independent inspector, dealership or appraiser to inspect said piece of equipment. It is the Bidder’s responsibility to do their DUE DILIGENCE and inspect the item and listing pertaining to said item. Each Bidder is responsible for his or her own independent inspection.
The highest Bidder at close of the Auction will be the Buyer.
ALL SALES ARE FINAL
1) Registration and Bidding:
All Bidders must register and be approved by the Auction Company. A credit/debit card number is required for online registration. A temporary payment of one dollar ($1.00) will be deducted and immediately refunded to verify the card. We may request verification of identity, including a government-issued ID.
Once a bid is placed, it is final. Bidders are responsible for their bids. We do not reverse bids placed in error.
The Auction Company determines bidding increments and reserves the right to reject any bid not in line with established increments or auction rules.
2) Firearms and Ammunition:
All sales and transfers of firearms will be conducted in compliance with federal, state, and local laws, including but not limited to the Gun Control Act and Colorado statutes.
All firearm Buyers will be required to fill out a Firearms Transaction Record (ATF Form 4473) and must complete a background check through a Federal Firearms Licensee (FFL). Firearms will not be released or shipped until the form and background check is successfully completed and seventy-two (72) hours have elapsed as required by Colorado State Law. Background check fees are currently twenty-five dollars ($25.00) and are valid for thirty (30) calendar days. There is additional sales tax on firearms and ammunition in Colorado that Buyer will be responsible for paying.
Firearms may also be transferred to another federally licensed firearm dealer of the Buyer’s choosing and Buyer can have their background check conducted by that dealer.
Firearms will only be shipped to a licensed FFL dealer. Buyer is responsible for providing FFL information and for any transfer or shipping fees incurred. Bidders must be twenty-one (21) or older to purchase any firearm. Bidders from outside Colorado must ensure their state allows the purchase and transfer of the firearm.
Ammunition is sold separately and cannot be shipped with firearms. All ammunition purchasers must comply with state and federal regulations.
It is a felony to knowingly purchase or acquire a firearm for a legally prohibited person, whether under federal or state law. C.R.S §18-12-111.
3) Meter Readings & Mileage:
All hour meter readings and mileages are believed to be true but are not guaranteed.
4) Buyer Premium:
Please view each item to determine if there is a Buyer Premium. The amount listed on the item will be added to the purchase price of any item that states there is a Buyer Premium.
5) Payment and Fees:
Payment must be received from Buyer within forty-eight (48) hours after issuance of the invoice. The Buyer will receive an invoice from Auction Company via the email provided at the time of registration. Buyer agrees to pay by Cash, Check, Credit Card or Bank Wire. Credit card payments may incur an additional fee, the Buyer is responsible for all bank wire fees and all returned checks are subject to a twenty-five dollar ($25.00) fee. If Buyer does not wish to pay the invoice with the card on file, they must contact Auction Company to coordinate payment within forty-eight (48) hours. If payment is not received within forty-eight (48) hours, the CARD PROVIDED AT REGISTRATION WILL BE CHARGED.
Colorado state and local sales tax will be applied unless the Buyer provides a valid resale or tax-exemption certificate. Buyers purchasing items used in the “direct production of agricultural commodities” may fill out a Colorado Sales Tax Exemption form for those items that fall under the exemption. When purchasing a titled vehicle Buyer will pay the sales tax when the vehicle is registered in the respective county where the vehicle is to be registered.
Buyer will receive a Paid in Full Invoice once payment has been received in full. This shall include invoiced amount plus any tax, credit card or wire transfer fees. No item can be picked up or shipped without the PAID IN FULL INVOICE.
6) Pickup, Shipping, and Risk of Loss:
Buyers are responsible for pickup within ten (10) business days of the Auction unless arrangements are made otherwise. Failure to do so will result in the item being RESOLD and no refund will be returned to the Buyer.
Shipping is the responsibility of the Buyer unless otherwise specified in the description of the item and is at Buyer’s expense. Items are shipped at Buyer’s risk. We are not responsible for damage or loss once items are released to the carrier.
Title and risk of loss pass to Buyer upon payment in full and pickup or shipment of the item.
7) Disputes and Remedies:
Buyers agree not to initiate chargebacks and to resolve disputes directly with the Auction Company. Unauthorized chargebacks are a breach of this Agreement. If a Buyer fails to pay or complete required paperwork (including for firearm transfers), the Auction Company may cancel the sale, retain any deposits, resell the item, and pursue legal remedies including costs and attorney’s fees.
This Agreement is governed by the laws of the State of Colorado. Venue for any disputes shall be in the courts of Moffat County, Colorado.
8) Additional Terms:
We reserve the right to refuse service, registration, or bidding to anyone at our discretion.
These Terms may be modified at any time by the Auction Company, and such modifications will be effective upon posting or notification.
In no event shall the Auction Company be liable for any indirect, incidental, or consequential damages arising out of or related to participation in our auctions. Auction Company is not responsible for accidents, thefts, errors or omissions.
Auctions may be timed, live webcast, or conducted via third-party platforms. Auction Company reserves the right to add or remove items from the auction; split or combine lots; add minimum bids or reserve prices. Auction Company reserves the right to cancel, suspend, extend or reschedule an individual item and/or auction event or to make changes to the auction closing times, inspections or removal times.
All items sold are SOLD AS IS, WHERE IS basis and no warranty of representation is either expressed or implied concerning the items. ALL SALES ARE FINAL! The Bidder/Buyer acknowledges they have read and agree to be bound by the Terms set forth herein.
